Términos y Condiciones del Servicio WEB EXPRESS 48H
Los presentes términos regulan la contratación del servicio WEB EXPRESS 48H ofrecido por DIKITAL (en adelante, el “Prestador”) al cliente (en adelante, el “Cliente”). La contratación del servicio y/o el pago del mismo implican la aceptación íntegra y expresa de estas condiciones. El titular del presente sitio web es JS&CO LLC, empresa con sede en New Mexico (Estados Unidos).
- Objeto del servicio
El servicio consiste en la creación y entrega de una web de una sola página (landing) orientada a la captación de clientes y al contacto directo (llamada telefónica y/o WhatsApp), conforme al alcance descrito en la oferta comercial.
- Alcance incluido
El servicio incluye exclusivamente:
Diseño y maquetación de una landing de una sola página.
Adaptación responsive (móvil, tablet y escritorio).
Integración de botones de contacto (teléfono y/o WhatsApp).
Inclusión de textos legales básicos y sistema de cookies.
Publicación inicial en una URL temporal facilitada por el Prestador.
Una (1) única ronda de ajustes menores tras la entrega inicial.
Asistencia puntual para la publicación en un dominio y alojamiento facilitados por el Cliente, sin que dicha publicación constituya parte esencial del servicio ni condicione su correcta entrega.
2.b. Textos legales orientativos (no asesoramiento)
Los textos legales facilitados o incluidos por el Prestador (por ejemplo, política de privacidad, cookies o aviso legal) tienen carácter general y orientativo, y se proporcionan como plantilla base de apoyo.
En ningún caso constituyen asesoramiento jurídico, fiscal o de cumplimiento normativo, ni sustituyen la intervención de abogados o profesionales cualificados. El Cliente es el único responsable de revisar, adaptar y validar dichos textos conforme a su actividad, tratamiento de datos y normativa aplicable.
- Exclusiones
Quedan expresamente excluidos, salvo acuerdo previo y por escrito:
Mantenimiento posterior.
Cambios estructurales o rediseños.
Revisiones adicionales fuera de la ronda incluida.
SEO avanzado o garantía de resultados.
Gestión continuada de hosting, dominio o correo electrónico.
Comercio electrónico.
Integraciones complejas.
Configuración o integración de herramientas de analítica o medición.
Desarrollos a medida.
- Plazo de entrega
El plazo estimado es de 48 horas hábiles, y comenzará a computarse únicamente cuando concurran ambas condiciones:
Confirmación del pago.
Recepción completa de la información necesaria por parte del Cliente.
Cualquier retraso imputable al Cliente suspenderá automáticamente el cómputo del plazo.
La web se considerará entregada y correctamente publicada una vez esté accesible en la URL temporal facilitada por el Prestador, con independencia de revisiones posteriores.
Las solicitudes de cambios, modificaciones o ampliaciones realizadas tras dicha publicación no formarán parte del alcance inicial del servicio y podrán presupuestarse aparte, salvo la ronda de ajustes menores incluida.
- URL temporal (vigencia)
La web se entrega publicada en una URL temporal para visualización y uso provisional. La disponibilidad de dicha URL podrá mantenerse hasta un máximo de 12 meses desde la fecha de entrega.
Transcurrido dicho plazo, el Prestador no garantiza su conservación ni disponibilidad, salvo acuerdo de renovación.
- Dominio y hosting definitivos
La contratación, titularidad y gestión del dominio y alojamiento definitivos corresponden al Cliente, salvo que se acuerde expresamente un servicio adicional de gestión anual.
El Prestador podrá prestar asistencia técnica puntual para la conexión, sin asumir responsabilidad por incidencias derivadas de proveedores externos, DNS, propagación o configuraciones ajenas.
- Sustitución de web anterior
Si el Cliente solicita publicar la nueva web sobre una web previamente existente, acepta expresamente que:
La publicación puede implicar la sobrescritura o pérdida del contenido anterior.
El Prestador no está obligado a realizar copias de seguridad ni a recuperar versiones previas, salvo acuerdo expreso por escrito.
Una vez aprobada la entrega o realizada la publicación definitiva, la web se considerará validada.
- Ajustes y revisiones
Se incluye una única ronda de ajustes menores tras la entrega inicial.
Cualquier modificación adicional, cambio estructural o ampliación de contenido podrá presupuestarse aparte.
- Garantía
La garantía se limita exclusivamente a la devolución del importe abonado en caso de incumplimiento objetivo del servicio contratado, consistente en que, transcurridas 48 horas hábiles desde la confirmación del pago y la recepción completa de la información necesaria, la web no esté publicada al menos en la URL temporal facilitada por el Prestador.
No aplica por cambio de opinión, expectativas subjetivas, resultados comerciales o posicionamiento.
- Limitación de responsabilidad
El Prestador no garantiza resultados económicos ni de captación de clientes.
No será responsable de fallos o incidencias derivados de terceros (hosting, dominio, DNS, correo electrónico o servicios externos), ni de configuraciones ajenas al servicio contratado.
En ningún caso responderá por daños indirectos, lucro cesante o pérdida de oportunidades de negocio.
- Legislación y jurisdicción
Estas condiciones se rigen por la legislación del Estado de New Mexico, Estados Unidos.
Para cualquier controversia derivada del presente servicio, las partes se someten expresamente a la jurisdicción de los tribunales competentes del Estado de New Mexico, con renuncia a cualquier otro fuero que pudiera corresponderles.
- Aceptación
La contratación y/o el pago del servicio implican la aceptación expresa e íntegra de los presentes Términos y Condiciones.

Warranty: Our digital marketing services will be performed in a professional manner consistent with industry standards. However, due to the ever-evolving nature of digital marketing and the external factors that may influence results, we do not guarantee specific outcomes or results from our services. Any projections, estimates, or performance metrics provided are for informational purposes only and should not be construed as guarantees.
Furthermore, while we strive to ensure the accuracy and effectiveness of our strategies and recommendations, we do not warrant that our services will be error-free or uninterrupted. We shall not be liable for any damages arising out of or related to the use or inability to use our services, including but not limited to lost profits, business interruption, or loss of data.
Any warranties provided herein are expressly limited to the services provided and do not extend to any third-party products, services, or platforms utilized as part of our services. Any warranties provided by third-party providers shall be governed by their respective terms and conditions.
Should you encounter any issues or concerns with our services, please notify us promptly, and we will make commercially reasonable efforts to address them in a timely manner.

Termination of Services: Either party may terminate our services upon written notice if the other party materially breaches these terms and fails to remedy such breach within a reasonable time period. Upon termination, any outstanding payments shall become immediately due. The customer may cancel any of the subscription services with a notice period of at least 30 calendar days prior to the end of its term.
Limitation of Liability: Our liability for any damages arising out of or related to our services shall be limited to the fees paid by you for the specific services giving rise to such damages. We shall not be liable for any indirect, incidental, special, or consequential damages.
Modification of Terms: We reserve the right to modify these terms of service at any time. Any such modifications will be effective immediately upon posting on our website or notifying you via email. Your continued use of our services after such modifications constitutes acceptance of the updated terms.
Governing Law: These terms of service shall be governed by and construed in accordance with the laws of New Mexico (United States), without regard to its conflict of law provisions. Both parties agree to use all means of mediation to resolve disputes before filing legal documents.
